James M. Campbell, Michelle I. Schaffer and Thomas A. Mountain obtained a summary judgment victory in the United States District Court in Perez v. Toyota Motor Sales, U.S.A., Inc..

The plaintiffs, Freddy and his son Jonathan Perez, were the driver and passenger of the Tacoma when the vehicle allegedly began to accelerate on its own accord, causing Freddy Perez to lose control.  Toyota argued that without an expert to opine as to any alleged defects in the throttle or braking systems, the plaintiffs could not sustain their claims.

The Honorable Judge Warren W. Eginton ruled in Toyota’s favor based on the plaintiffs’ inability to sustain their burden to raise an inference that the asserted defect existed at the time of the manufacture and sale of the car.  

James M. Campbell served as lead trial counsel for Toyota Motor Sales, U.S.A., Inc.. in this case. Michelle I. Schaffer and Thomas A. Mountain served as co-counsel.
