Summary judgment was granted in a negligence action arising from a motor vehicle accident that occurred in January 2014 at the intersection of Bedford and Kingston Streets in downtown Boston. Plaintiff was injured while crossing Bedford Street when he was struck by the co-defendant driver’s vehicle. Plaintiff claimed that the driver’s vision was impaired as a result of steam coming from a manhole cover owned by Energy Company. Plaintiff alleged Energy Company was negligent because it allowed steam to rise through the manhole cover and into the street thereby impairing the driver’s vision of Plaintiff in the crosswalk. Energy Company denied that it was negligent and alleged it was entitled to summary judgment because Plaintiff’s claim alleged a defect or want of repair in a public way, so was governed by the Massachusetts Defect in Public Way Statute, M.G.L. c. 84 §15. Under the statute, Plaintiff was required to give written notice to Energy Company of the allegedly defective condition within thirty (30) days of his injury in order to bring his claim, but Plaintiff failed to provide the required notice within the requisite timeframe. The Court held that Energy Company was entitled to summary judgment and dismissed the Plaintiff’s claims against Energy Company.

Rona Eli, an attorney at Campbell Campbell Edwards & Conroy, P.C. and active member of the Asian American Lawyers Association of Massachusetts (AALAM) and chair of the Diversity Committee for the Massachusetts Chapter of the Federal Bar Association spoke at the 49th Annual Northeast Region of National Black Law Students Association’s Regional Convention on Thursday, January 27, 2017 along with the Massachusetts Assistant Attorney General of the Civil Rights division. Ms. Eli discussed the importance of affinity bar associations and groups in the law, and how it has impacted her own practice. The Northeast Region of National Black Law Students Association’s Regional Convention celebrates diversity in the law and allows organizations to connect with diverse students from across the nation. The Northeast Region is the founding region of the National Black Law Students Association. The plaintiff, Christopher O'Leary, alleged that the defendants negligently maintained their property and were responsible for injuries he sustained after falling down an open shaft on the roof of a vacant commercial building.

The court granted summary judgment in the defendants' favor because they did not owe the plaintiff any duty of care with respect to the open and obvious danger of the shaft, and at the time the plaintiff was an adult trespasser. The court also found that even had the plaintiff asserted a separate claim for willful, wanton and reckless conduct there were no facts to support this claim. View full opinion.
