Jackson v. American Honda Motor Company, Inc.
This case concerns claims brought by the plaintiff concerning the lease of a 2004 Honda Civic Specifically, she claimed the existence of a defect or nonconformity in the manufacture of the vehicle. Claims were brought under the Massachusetts New Car Lemon Law, the Magnuson Moss Warranty Improvement Act and Massachusetts Chapter 93A.
Honda moved for summary judgment because the plaintiff had no reasonable chance of proving her claims under any of these theories. And the trial judge agreed, entering summary judgment in favor of Honda on all of these claims, a ruling which was also upheld on appeal.
