Vaughn v. American Automobile Association, Inc.
Travelers brought suit against travel agency in state court for damages allegedly sustained as a result of a trip to Italy being cut short when their luggage was lost. Action was removed. Holding: On travel agency's motion for summary judgment, the District Court, Gertner, J., adopted report and recommendation of Dein, United States Magistrate Judge, which held that travel agency's alleged conduct of failing to assist travelers in recovering lost baggage did not violate Massachusetts deceptive trade practices law. Motion granted.
