Dolceamore v. Crown Equipment Corporation
Plaintiff, a 26 year old woman, alleged that the brakes on the forklift that she was driving failed and the vehicle would not stop. In an effort to avoid hitting a wall, she turned the truck to her right and hit a steel railing, crushing her left ankle. Plaintiff’s experts claimed that the truck should have had either: 1) a door on the operator's compartment, or 2) an alternative location for the operator's compartment to reduce the risk of intrusion injury.
