Rapine v. Gilbane v. Kone
Our client fully settled a lawsuit arising out of a workplace accident, then pursued a contractual indemnification claim against a non-settling defendant, seeking reimbursement of a portion of the settlement amount. The jury awarded $2 million to our client. Action for indemnification for a settlement paid following a construction site accident in which a heavy metal bar fell several stories and hit a worker in the head. Gilbane, the general contractor, paid $9.5 million in settlement and in this trial pursued indemnification from Kone, the worker's employer. A verdict for Gilbane opened up a further $5 million in coverage from an OCIP policy provided to Gilbane through Kone.
