Bedford Drywall Corp. v. Ford Motor Company
Plaintiff complained that certain problems with the transmission and engine of its 2004 Ford F-550 have rendered the vehicle inappropriate for its intended commercial use. When the vehicle was purchased, the F-550 had a Gross Vehicle Weight Rating (GVWR) of 17,500 pounds When plaintiff registered the vehicle it had a Vehicle Weight of 23,000 pounds, which was 6,500 pounds above the GVWR. Ford contended that the majority of the complaints regarding the subject vehicle were the result of the plaintiff's overloading of the truck and misuse of the vehicle.
