Henderson v. Krystal Koach, et al.

Defendant driver of a 2000 Lincoln TownCar stretch limousine, lost control of the vehicle while traveling 65 mph on the Garden State Parkway, veered off of the roadway and onto a grassy berm, and downhill into a line of several large trees. The right rear seat passenger was killed instantly from the tree impacts. Other passengers sustained injuries. Plaintiffs alleged that Krystal Koach had improperly "stretched" the limousine and that as a result, the vehicle frame rail started to come apart while on the roadway, causing the driver to lose control. In addition, Plaintiffs claimed that the vehicle was not crashworthy as a result of the improper welding of the frame, which caused excessive vehicle damage and enhanced the injuries sustained in this crash.
