Anthony v. Ford Motor Company
The plaintiff in the case was the unrestrained right rear passenger of an unregistered, modified 1985 Ford Bronco that was being driven off-road, at night, through unlit private property to an excavated site dug in preparation for the building of a new home. The driver drove onto the wrong trail and then drove the Bronco into the excavated portion of the site, estimated to be between eight and twelve feet deep. Plaintiff fractured her cervical spine in the accident and was rendered a quadriplegic. Plaintiffs allege that the design of the roof was defective and not crashworthy.
