Brady v. Ford Motor Company
On November 17, 1999. Plaintiff was the right front seat passenger in a 1999 Crown Victoria rental vehicle driven by a co-worker. The Crown Victoria was traveling eastbound on West Mercury Boulevard in Hampton, Virginia, and stopped at a red light. While stopped at the light, a 1987 Cadillac Seville struck the Crown Victoria in the rear. On impact, The front passenger seat of the Crown Victoria yielded, resulting in injuries to the plaintiff. The plaintiff was wearing a seat belt at the time of the accident and was retained in his seat. Seat deformation was minimal. Plaintiff alleged that Ford should have been aware of the propensity of the passenger seat to collapse, but failed to correct the defect.
