Santander Consumer USA v. Walsh

Trademark owners brought action against competitors, alleging trademark infringement, false designation of origin, unfair competition and trademark dilution claims under the Lanham Act and Massachusetts and Texas law. Competitors counterclaimed for fraudulent procurement and declaratory relief under Lanham Act and antitrust under Sherman Act and Massachusetts law. Competitors moved for summary judgment, and trademark owners moved for judgment on the pleadings and to strike declaratory judgment count.
