Paredes v. Ford Motor Company

Plaintiff was driving his 2000 Ford Explorer Sport on Route I-78 at approximately 55 mph when another vehicle cut him off. Plaintiff jammed on his brakes, causing the vehicle to swerve out of the left lane, onto the left shoulder and then back into the left lane.  The vehicle rolled 4 to 6 times on the roadway. The plaintiff sustained a traumatic brain injury, as well as multiple fractures.  Two months before the accident, a dealership replaced the Explorer's tires pursuant to a recall.  After the replacement, plaintiffs noticed that when applying the brakes, the vehicle would "jump sideways."  Plaintiff alleged that the vehicle was defectively designed due to its propensity to roll.  Plaintiff further alleged that Ford failed to provide adequate warnings about the stability of the vehicle and type of tires placed on the vehicle.

This case was tried to a unanimous defense verdict in Middlesex County, NJ. The case involved a Ford Explorer rollover accident which rendered the plaintiff brain damaged and permanately disabled.
