Baen v. Dorman Products
The plaintiff lost an eye when a cutting disc shattered during use and flew into his face. He brought suit in Philadelphia County, Pennsylvania, alleging in his complaint that the disc was defectively manufactured and that it contained inadequate warnings. He named our client as well as our client’s distributor, claiming that they either manufactured the disc or were in the chain of distribution. Through sophisticated expert investigation and deposition testimony of eyewitnesses, we were able to show distinct differences between the disc involved in the accident and the type of disc sold by our client. All parties, including the plaintiff, voluntarily dismissed our client as well as its distributor from the case.
