Alvarez v. Ford
Three occupants of a Ford Explorer (a mother, father and daughter) were ejected and killed during an off-road rollover accident in Mexico. The case was filed in the Delaware Superior Court. Two passengers (brothers and sons of the parents killed) survived the accident. The case was dismissed with prejudice with no payment by Ford after investigation and discovery revealed that the survivors had lied to police about who was driving the vehicle. They claimed the deceased father was driving even though one of the surviving sons had been driving.
