McGee v. Fanelli Group d/b/a Pleasant Valley Homes
Plaintiff contracted for the installation of a modular home on his property in Rockland, MA. The plaintiff alleged that, as a result of manufacturing defects, the modular home components failed to properly connect to the foundation. He filed claims against the modular home manufacturer for breach of contract, breach of warranties, negligence, and under Ch. 93A for unfair trade practices. The manufacturer moved for a motion to dismiss for failure to allege facts sufficient for a claim and the applicable statute of limitations.
