Maldando v. Ford
Plaintiff was a young woman who was struck by a drunk driver as she attempted to reset a fuel cutoff switch in the rear of her vehicle. As a result of the collision, the plaintiff sustained an amputation of her leg. The plaintiff claimed that the cutoff switch was defective and should not have activated on the night of the accident. Ford showed that the fuel cutoff switch was not defectively designed and that the actual cause of the accident and the plaintiff’s injuries was in fact the actions of the drunk driver. The jury returned a defense verdict.
