Featured Case: Campbell helps Honda Defend Integrity of ATV Design

Honda firmly believes in the integrity of the designs of all their vehicles and staunchly defends any claims of defect.

When a 16-year old crashed his ATV after inadvertently driving over a stump at 25-miles per hour and died as a result of being thrown into a tree, they blamed it on the faulty design of the vehicle. Honda called on Campbell Trial Lawyers to help defend the claim.  The plaintiffs claimed that a defect in the rear swing arm pivot nut casued a bracket to fail, sending the ATV out of control and into a tree, resulting in the death of the driver.

So strongly does the company stand behind their products, that the Japanese engineers who designed the ATV came to the United States and testified how thoroughly they evaluate each aspect of the design.  These engineers and an expert metallurgist called by the defense, came into court and got on their hands and knees to point out key details, such as the precise postion of paint mark on the bolt (applied in the factory) which proved there was no defect in the pivot nut.
