Morse v. Ford Motor Company

The case arose out of an accident in October of 2005 in which the injured plaintiff was a passenger in a 2004 Ford Focus. The plaintiff alleged that the operator was caused to lose control of the vehicle by a sudden separation of the right front tie rod due to a defect, and that the plaintiff 's injuries were caused by the failure of the passenger side airbag to deploy. Ford moved for summary judgment on the grounds that the plaintiff's sole liability expert was unqualified and lacked a scientific basis for his opinions regarding the cause of the accident and the plaintiff's injuries. Judge Stearns of the USDC of Massachusetts excluded the testimony of plaintiff's experts and subsequently entered summary judgment in favor of Ford on July 13, 2010.
