Colgate Palmolive Awarded Summary Judgment

Jim Campbell represented Colgate Palmolive in a case brought by a consumer who alleged that she sustained injuries as the result of the use of toothpaste. The plaintiff relied on the testimony of her treating doctors to support her claims that the toothpaste caused her physical problems. The court found that the plaintiff had insufficient evidence of defect and that her failure to read the product labeling defeated the failure to warn claims. The case dismissed following the entry of summary judgment.
