Kiak v. Crown Equipment Corporation
The case arose out of an accident that occurred in a warehouse of a foundry that made various pipe-related products. As Plaintiff was looking down into a box to consolidate valves, another employee backed a forklift down the aisle in which Plaintiff was standing and pinned him between two boxes, injuring Plaintiff. Plaintiff had one foot amputated, then reattached, and other foot severely crushed. Plaintiff claimed the forklift was defective because its backup alarm did not sound when it was coasting backwards in neutral.
