Favia v. Ford Motor Company
The driver of a 1994 Ford Aerostar was traveling in the passing lane of I-74 because of construction in the driving lane. The driving lane was 5” to 7” lower than the passing lane, which was freshly paved. The driver lost control of the vehicle when it drifted partially into the driving lane. The vehicle rolled and ejected the driver and 4 passengers. The driver and 3 passengers died; the fourth passenger suffered catastrophic injuries. The plaintiffs alleged an inadequate suspension system, instability in the steering system, inadequate door latches and a failure to warn of these alleged defects and claimed damages in excess of $ 20 million. The jury returned a unanimous verdict for the defense.
