Fernandez v. Hino Trucks

In this Massachusetts Superior Court case the plaintiff was driving a Hino delivery truck and claimed that loss of steering control caused the truck to go off Route 1 Northbound in Revere, Massachusetts and rollover down an embankment. The plaintiff sustained a fractured cervical spine and other serious head injuries in the accident and was permanently disabled from employment. The truck was subject to a Recall Campaign for the steering system. The case was dismissed with prejudice with no payment by Hino after a witness to the accident was found and deposed. He testified that the plaintiff’s version of the accident was false and that the plaintiff was driving too fast for the existing rainy conditions and drove straight off the road at a sharp left bearing curve.
