Featured Case: Franchisor versus Franchisee Liability

The case centered on an attack on a woman who regularly brought her children to swimming lessons at a local hotel.  One day, as she and her children were getting back into the car after the lesson, a man with a gun attacked and raped her.  She screamed as she tried to get away, but the man ran.  He was later arrested.

Both the local hotel and the franchisor were name in the suit brought by the woman.  This case brings up the question to what extent the franchisor can be held resonsible for the actions of the franchisee.  The franchisor sets the broad standards and guidelines for each franchisee to adhere to and maintain.  The franchisee, on the other hand, is responsible for the day-to-day operations of the hotel, the hiring and firing of staff and for the smooth operation of the establishment on a daily basis.
