Featured Case: Drug Makers Look to Campbell for Mass Tort Defense

A pair of pharmaceutical manufacturers of metoclopramide has turned to the Campbell Trial Lawyers to fend off a mass tort assault by more than 800 plaintiffs in Massachusetts, New Jersey and Pennsylvania. Metoclopramide is the generic version of the Reglan drug used to relieve nausea, vomiting, heartburn and loss of appetite in diabetics and other patients with damaged stomach nerves.

A total of more than 3,000 plaintiffs nationwide have already joined in the attack on the drug makers, alleging that they failed to warn of possible side effects of taking the drug, including Tardive dyskinesia, which is characterized by repetitive and involuntary movements, such as lip smacking, grimacing and rapid eye blinking.

“The U.S. Supreme Court has issued an opinion which could affect the outcome of this case, holding that drug warning claims are generally pre-empted by federal law,” says James M. Campbell, lead lawyer for the regional defense team.
